GENERAL TERMS AND CONDITIONS

INTRODUCTION

These general conditions (hereinafter ‘Conditions’) shall apply to the services provided on our website (https://derm-nix.com) and on the links to social networks that appear at the bottom of this website (hereinafter, our ‘platforms’), and bind users with respect to the use of our Platforms and purchases made on them. These Conditions are complemented by the Privacy Policy and the Cookies Policy with regard to the processing of personal data used for the provision of the service, so it is important that you read these documents carefully before using any of our Platforms, since with their use you are bound by the rules contained in them.

WHO ARE YOU CONTRACTING WITH?

When you buy some of the products of our Platforms you will be contracting with the entity Nixarian Institute SLP, with CIF B40599136, domiciled in C/ Marqués de Dos Aguas 2 (46002 – Valencia – Spain).

OBJECT

This document regulates the conditions under which the user contracts the products and/or services offered on our Platforms, constituting the basic document that will regulate the relationship between the user and the service provider.

It is essential that you read and understand these terms and conditions before making your purchase. If you do not do so, please do not tick the box to accept the terms and conditions at the time of purchase.

RESPONSIBILITIES

The provider shall not be liable for any interruption in the access, functioning and operability of the website, provided that this is due to unforeseeable causes or force majeure, including but not limited to governmental action, fire, natural disasters, insurrection, technical failure, riot, explosion, terrorist action, legal strike, errors in the telematic networks or any other circumstance beyond or beyond the control of the provider.

The provider undertakes to ensure that the contents, data or information regarding the products or services offered on its website are reliable, truthful and accurate, and is responsible for the prices and characteristics advertised. However, it shall not be liable for any information that has been entered or displayed by third parties outside the provider.

The provider focuses solely on the sale of the products offered through the website. All the products offered have their corresponding factory guarantee, as well as the legally established return periods before the provider. For more information regarding warranties, please see the section ‘warranties and claims’.

This merchant does not permit any transactions that are illegal, or that may be deemed illegal by credit card brands or the acquiring bank, that may or have the potential to damage the goodwill of, or negatively influence them. The following activities are prohibited under the card brands’ programmes: the sale or offer of a product or service that is not in full compliance with all laws applicable to the Purchaser, Issuing Bank, Merchant, Cardholder, or cards.

The contracting of products and services on our Platforms are reserved for persons over 18 years of age. To avoid contracting by minors, we have limited the registration of users by date of birth, the user being responsible for the veracity of the data provided. In the event of false information and access to our Platform by minors, the legal representatives of the minor will be responsible for any damages that may occur.

Dermnix Lab is a registered trademark of Nixarian Institute SLP, hereafter ‘the company’.

Right of withdrawal

In accordance with the law, you will have a period of fourteen (14) days from the date of receipt of the products (or the last product if there were several products in the same order and you receive them separately) to exercise the right of withdrawal without having to justify the reasons or pay penalties, you will only have to assume the shipping costs of the return, being an essential requirement that you send your communication before the end of the aforementioned period. The communication must be made to our Customer Service Department.

However, in order to carry out the return, the product must be delivered with the packaging in perfect condition, the product and its accessories must be in perfect condition, and the product must be packaged in such a way that it cannot be damaged during transport, the latter being responsible for any possible damage during transport. The company will not accept the return of the product when it shows obvious signs of use. The returned product must be accompanied by a photocopy of the purchase receipt, order confirmation email or the sticker with details of the order that is included in the box you receive with your products.

Once we receive the goods in our warehouse and after checking the condition of the same, we will proceed to refund the amount according to the method of payment made by the customer. Shipping costs will not be refunded in any case.

When a return is made, if your order includes a gift or promotion, the gift must also be returned for the corresponding refund to be made.

Cancellation

If you cancel an order for no apparent reason, which has already been paid for and shipped, you will be charged a penalty of £7.99 for shipping and handling.

Warranties, complaints and wrong delivery

Our products have the corresponding legal guarantee. In the event of any type of non-conformity, you must contact the Customer Service Department immediately after you become aware of the non-conformity, sending a message to hola@derm-nix.com indicating the reason for the return.

In this regard, unless there is evidence to the contrary, it will be understood that the products are in conformity with the contract when:

They conform to the description given and possess the qualities of the product that the seller has presented to the consumer and user in the form of a sample or model.
They are fit for the purposes for which goods of the same type are normally intended.
Are suitable for any special use required by the consumer and user when he has made this known to the seller at the time of conclusion of the contract, provided that the seller has accepted that the product is suitable for such use.
They are of a quality and performance which are normal in a product of the same type and which the consumer and user may reasonably expect, taking into account the nature of the product and, where appropriate, public statements on the specific characteristics of the products made by the seller, the producer or his representative, in particular in advertising or on labelling. The seller shall not be bound by such public statements if he proves that he was unaware and could not reasonably be expected to have been aware of the statement in question, that the statement had been corrected at the time of conclusion of the contract or that the statement could not have influenced the decision to purchase the product.

In the event that the product is returned due to lack of conformity (defective products or incorrect shipments), you will have the right to choose between the refund of the amount paid, or the restitution of the product for another product of identical characteristics. The company will be responsible for the cost of sending or returning the product.

In the case of return due to incorrect delivery, the product must be delivered with the packaging in perfect condition, the product and its accessories must be in perfect condition, and the product must be packaged in such a way that it cannot be damaged during transport, and the company will be responsible for any possible damage during transport. The company will not accept the return of the product when it shows obvious signs of use.

In the event of a defective product, the user will try to return the product in the best possible condition.

The refund will always be made according to the way in which you have initially paid for the purchase and provided that the above requirements are met. In the case of cash on delivery purchases, the refund will be made by bank transfer to the account you indicate, or by means of a discount voucher redeemable in the online shop itself (https://derm-nix.com).

For any claim related to your order received, we need you to provide us with several images of the state of the box and packaging, from all angles, including the base part, within a maximum period of 48 hours from the time of receipt.

MODIFICATION OF DATA AND CONDITIONS

The company reserves the right to modify the commercial offer presented on the website (products, prices, promotions and commercial and service conditions) at any time. Any new version of these will be previously indicated in this section and will not be retroactive.

SAFEGUARD CLAUSE

All the clauses or extremes of the present contract must be interpreted independently and autonomously, and the rest of the stipulations will not be affected in the event that one of them has been declared NULL and VOID by a final judicial sentence. The contracting parties agree to replace the clause or clauses affected by another or others that preserve the effects pursued by the parties.

APPLICABLE LAW AND JURISDICTION

These Conditions are governed by Spanish law.

RESOLUTION OF CONFLICTS

For those conflicts that could be generated between the consumer and Nixarian Institute SLP as a result of a breach of the conditions of contract, will be governed by the provisions of the current legislation, being applicable the rules of the Spanish legal system. Such disputes must be discussed in Valencia (Spain) where the headquarters of the company is located.

If any of these terms is considered null and void or unenforceable, such provision shall be deemed not to have been made and shall not affect the validity of the remaining provisions.

We inform you that there is a European platform for out-of-court online settlement of disputes relating to contractual obligations arising from contracts of sale or provision of services concluded online between a consumer and a trader resident in the European Union, through the intervention of an alternative dispute resolution entity.
